This case is before us upon tbe objections of tbe respondents to tbe right of tbe appellant to be beard on any errors assigned in the transcript, on tbe ground that tbe evidence is insufficient to support tbe findings of facts by tbe court below. The' ' cause was tried by the court without a jury, and two judgments were rendered, April 22, 1875. Tbe appellant recovered $1 as *344damages, and the costs of the action were taxed against him.
