L INTRODUCTION

On October 28,1992, the plaintiff, Endicott Enterprises, Inc., Va Eneo (“Eneo”), brought this Miller Act, 40 U.S.C. §§ 270a-270d, action against defendants, Star Brite Construction Company, Inc. (“Star Brite”) and Employers’ Insurance of Wausau, A Mutual Company (“Wausau”), to recover amounts due for work it allegedly completed under its subcontract with Star Brite to perform the mechanical work of Star Brite’s prime contract with the United States Government to renovate three airplane hangers at the Dover Air…
