The appellant, Ulysses Charles Sneed, was indicted for the capital offense of robbery-murder for the 1993 killing of Clarence Nugene Terry. See § 13A-5-40(a)(2), Ala.Code 1975. In 1995, he was tried with codefendant John Hardy, convicted of capital murder, and sentenced to death. 1 We affirmed his conviction and death sentence, see Sneed v.
