AUGUSTUS N. HAND, Circuit Judge.
In this action the plaintiffs seek to recover for use by the defendant of an alleged novel plan originated by them and submitted to the defendant under circumstances indicating that they were to be paid for the use.
The plaintiffs alleged that in the latter part of 1933 they conceived the idea of constructing automobile bodies of tire coupe type so as to eliminate the rumble seat and to utilize the unused space immediately behind the driver’s seat for the seating of passengers and carrying luggage without the necessity of lengthening the body.
