Before the court is defendant New Hampshire Speedway’s (“speedway”) Motion for Summary Judgment (doc. no. 13) brought pursuant to Federal Rule of Civil Procedure 56(a). In this motion, defendant seeks that the complaint be dismissed as there are no genuine issues of material fact that defendant did not owe plaintiff a legal duty to protect plaintiff from the negligent drivers operating on a public way.
