The plaintiff in error, hereinafter called defendant, was convicted in the county court of McIntosh county on a charge of having possession of a compound mixture fit for distillation and manufacture of whisky, and was sentenced to pay a fine of $100 and to be imprisoned in the county jail of McIntosh county for a term of sixty days. From the judgment, the defendant has appealed.
