delivered the opinion of the court.
Appellee brought an action in the Municipal Court against appellants on two promissory notes signed by appellants. The declaration in the usual form was filed and attached thereto were copies of the notes sued on and an affidavit of claim.
Appellants appeared, demanded a jury and filed pleas and an affidavit of merits. This first affidavit was, by order of court, on motion, stricken from the files for insufficiency. Appellants took leave to file an amended affidavit of merits, and on May 9, 1910, filed their amended affidavit of merits.…
