MEMORANDUM OPINION AND JUDGMENT

This is an action by the Government of the Virgin Islands against an alleged “uninsured employer” seeking to recover certain Workmen’s Compensation payments made from the Government Insurance Fund to the parent of a deceased maritime employee, and for statutory penalties.

Defendant moves this Court for an Order dismissing the complaint pursuant to Rule 12 F.R.C.P., alleging that the complaint fails to state a cause of action upon which relief may be granted, and that this Court lacks jurisdiction over the subject matter on the grounds that the Virgin Islands…
