The “Carpenters Joint Trust Funds,” purportedly acting as *610plaintiffs, commenced this action to compel the defendant contractors to specifically perform an agreement to allow examination of their books and records to determine if they were paying all sums required to be paid to the trust funds. The contractors answered asserting that “Carpenters Joint Trust Funds” is not a legal entity and does not possess the capacity to sue, and asserting that the trustees of the named trusts were the real parties in interest.
