This proceeding was instituted before the mayor of the city of Greenfield, a trial and conviction following, from which judgment the appellee appealed to the circuit court, where he made a motion to quash the affidavit for want of facts. This motion was sustained, and the State appeals. The affidavit, omitting formal parts, is as follows: “On or about the- day of February, in the year 1905, at the county of Hancock and State of Indiana, one Thomas H.
