Pending in this breach of contract action are defendant’s January 19, 2006 motion for reeonsideration of our ruling of December 20, 2005, in which we held that the government had breached its contract with plaintiffs, and defendant’s June 6 and October 1, 2008 motions that we take judicial notice of certain *17recent legislative activity, as well as current fluctuations in the price of oil.
