When these cases were first before us, we reversed the judgments against Eastern Air Lines in an opinion to which reference is made for a statement of the factual situation. 1955, 95 U.S.App.D.C. 189, 221 F.2d 62. We held that, since the pilot of a National airliner flying in the general vicinity was admittedly not in a position during all of the critical period to hear radio messages sent by the control tower to the Eastern plane, and since he appeared not to have been fully attentive to such tower broadcasts as he actually did hear during that period, the…
