This is an action to recover a parcel of land of .166 acres (icuerdas) brought on April Sfy 1946, in the District Court •of Bayamón, by José R. Ramos Mimoso against tbe People of Puerto Rico and tbe Department of tbe Interior.1 The •defendants filed a motion for dismissal, alleging that the •complaint does not state facts sufficient to constitute a cause of action inasmuch as the action is haired. In support of *602this motion defendants filed a second motion which, in its pertinent part, reads thns:
