— Affirming.
Appellees instituted this action under section 11 of the Kentucky Statutes to quiet their title to 100 acres of land, alleging in themselves as was necessary both title and possession. The appellants by answer and counterclaim asserted superior title to the land under a tax deed to them from the auditor and asked to have their title quieted, thereby waiving the question of possession and electing to try title simply.
