This was an action by the appellee against the appellant, Charles C. Anderson, and George W. Becker, upon two joint promissory notes and to enforce a vendor’s lien.

The complaint consisted of four paragraphs. A demurrer was sustained to the first, second, and third paragraphs, and overruled to the fourth, to which rulings proper exceptions were taken. Issue was formed on the fourth paragraph of the complaint. The cause was, by the agreement of the parties, submitted to the court for trial.
