MEMORANDUM OPINION

SULLIVAN, District Judge.

This matter is before the Court on the parties’ cross-motions for summary judgment pursuant to Fed.R.Civ.P. 56(e). Upon consideration of the undisputed facts, relevant statute, regulations and case law, and the record herein, the defendant’s motion for summary judgment is GRANTED and the plaintiffs motion for summary judgment is DENIED.
