MANSFIELD, Circuit Judge.

On August 24, 1972, plaintiff, Chester Spatt, a resident of New York and a student at Princeton University, New Jersey, commenced this action by filing a pro se complaint requesting that a three-judge panel be convened, 28 U.S.C. §§ 2281, 2284, to declare unconstitutional New York Education Law § 602(5) (b) (McKinney’s Consol. Laws, c. 16, 1972 Supp.).
