Tbe plaintiff in error was by information charged with possession of intoxicating liquors ; was tried, convicted, and sentenced to pay a fine of $50 and to be imprisoned in the county jail for 30 days. The record, was properly saved, and defendant appeals.. The state to maintain the charge in the information against the plaintiff in error, who will be referred to herein as the defendant, called Elmer Finley, who' stated:
