Deen, Presiding Judge.

1. This is an action for breach of contract. Leifer, the plaintiff, listed certain property for sale with the defendant Prickett Realty Co., who procured the co-defendant Sewell to sign a contract of purchase. Sewell thereafter reneged and allegedly stopped payment on the earnest money check in the sum of $500, half of which would otherwise have gone to the plaintiff and the other half to the co-defendant. Leifer then sued Sewell and the real estate company for $250 each plus punitive damages, and later amended the prayer as to Sewell by seeking "$3,000 actual damages”…
