This cause was originally filed in the Lake Circuit Court by appellee on the 24th day of October, 1958. On the same date, a petition was filed by the AFL-CIO, Local 1460, to intervene in said cause.
Said cause was venued to the Newton Circuit Court on the 6th day of November, 1958.
Subsequently, on the submission of plaintiff’s appli*163cation for a restraining order without notice “to the court for hearing and determination,” the court “having heard the evidence adduced, and the argument of counsel and being fully advised in the premises now finds that the averments of the plaintiff’s complaint…
