Plaintiff sued for $2,361.82 damages for timber alleged to have been taken by defendant from plaintiff’s land and from the land of a neighbor, whose claim plaintiff had bought. Defendant denied having taken the timber. The ease was tried by a jury, who rendered a verdict in favor of plaintiff for $25. Defendant has appealed; and plaintiff, answering the appeal, prays that the amount of the judgment be increased to the sum sued for.
