KRUEGER, Judge. —

The appellant was tried and convicted of the offense of murder, and his punishment assessed at death.

The testimony adduced upon trial, briefly stated, is as follows: On the afternoon of January 22, 1933, the appellant, Glenn Hunsucker, and Bernice Inman, in a Ford coupe, drove to the town of Happy, engaged a cabin at a tourist camp, and some time before midnight left the cabin, drove up to a filling station and stopped.
