BERRY, Judge.

The appellant was convicted in the District Court of Wichita County for the offense of murder and his punishment assessed at confinement in the penitentiary for a term of twenty-five years.

The state’s testimony shows an unprovoked killin tr while appellant’s theory and his testimony is to the effect that the killing was purely accidental.

There are many complaints contained in the record but we. do not deem it necessary to discuss many of them. We think that there are but two questions raised that are of sufficient importance to warrant discussion. Appellant by a proper bill of…
