Adele N. Ellice, individually and as executrix of the estate of her deceased husband, Douglas V. Ellice, instituted this action seeking to recover the *219proceeds of an accident insurance policy issued by the defendant, the INA Life Insurance Company of New York, to the plaintiffs decedent’s employer, Shear-son/American Express, Inc.
