This appeal is from an order of the Circuit Court for Montgomery County, granting a motion to dismiss a petition for mandamus filed May 29, 1953, against the members of the State Tax Commission of Maryland and entering a judgment of non pros as to them; and sustaining a demurrer to the petition as against the members of the Appeal Tax Court for Montgomery County and dismissing the petition as to them. In the same order the demurrer of Wilton T. Allen, Supervisor of Assessments for Montgomery County, was overruled, with leave to answer. Believing that an appeal would be premature, no appeal…
