MEMORANDUM AND ORDER

SAFFELS, District Judge.

This matter is before the court oh motion by plaintiffs counsel for a determination and award of attorney fees.pursuant to 42 U.S.C. § 406(b)(1) (Doc. 44).

I. BACKGROUND

On March 25, 1992, plaintiff filed an application for a period of disability and disability insurance benefits under Title II of the Social Security Act, 42 U.S.C. § 401 et seq. Plaintiff alleged that he became unable to work because of his disabling condition on December 31, 1988.
