PARKER, Circuit Judge.
This ease eomes before us on cross-writs of error. Greenebaum Sons Bank & Trust Company, a corporation of Chicago, was plaintiff in the District Court, and the Ohio Valley Bank of Huntington, W. Va., and M. J. Ferguson, its vice president, were defendants. For convenience, the parties will be designated in this opinion according to the positions which they occupied in the court below. The action was one to recover damages against both defendants for deceit alleged to have been practiced, by them upon the plaintiff. The jury returned a verdict for $26,019.31 in favor of…
