A brief statement of the facts herein is contained in the abstract of the record by the appellant herein which is as follows: “This proceeding came to the lower Court on an appeal from an award of the respondent to the appellant for damages incident to construction of a portion of the Chugwater-Cheyenne highway across the lands of the appellant, said lands being located in Sections 15, 22 and 27, Township 19 North, Range 67 West of the 6th P.M., Laramie County, Wyoming.
