This case presents the question whether an insurance company’s refusal to continue to pay benefits to an insured under a disability insurance policy on the ground that the insured is no longer entitled to benefits violates Conn.Gen.Stat. § 38a-816(12), a provision of the Connecticut Unfair Insurance Practices Act (CUIPA) prohibiting dis crimination based on physical disability (“subsection (12)”).
