This is an action in the nature of quo warranto brought in this court by the State of Oregon, on the relation of Andrew L. Clark, against the defendant, W. A. Harris, wherein it is contended that the defendant is guilty of usurping and unlawfully exercising the office of county judge of Columbia County. It is contended, also, that the relator, Andrew L. Clark, is the duly elected and qualified county judge of said county and entitled to said office, etc. The petition or complaint states the facts relied upon by the plaintiff.
