I. INTRODUCTION

On February 25, 2000, plaintiff Gilbert W. Beneway (“Beneway” or “plaintiff’) commenced the instant diversity action against defendants Superwinch, Inc. and Superwinch, Ltd. (collectively, “Super-winch”), AW Direct, Inc. 1 , and Kulkoni, Inc. (“Kulkoni”), pursuant to 28 U.S.C. § 1332. Beneway amended his complaint on July 11, 2000, October 30, 2000, and again on December 18, 2001, asserting causes of action for negligence, products liability, and breach of warranty.
