The facts of the case are not in dispute. The procedures resulting in the contested judgment were summary, The sole issue of the case is the constitutionality of section 8102 of the Welfare and Institutions Code. This section provides for the confiscation of “deadly weapons” found in the possession of a person who is detained for examination as to mental condition. The statute provides that the weapons will not be released except upon order of the superior court.
