MEMORANDUM OF DECISION
NEWMAN, District Judge.
This suit against defendant, Sperry Rand Corporation, is brought by three of its former employees on behalf of the 270 non-salaried employees whose employment was terminated when the defendant’s Waterbury Tool Division was closed on June 24, 1966. Plaintiffs’ claims arise out of a contributory pension plan (i. e., one to which both employee and employer contribute) that Sperry Rand maintains for its em ployees.
