HAMILTON, District Judge.

This case is pending before me on a motion to dismiss under Equity Rule 29 (28 U.S.C.A. following section 723).

On December 3, 1927, Lillian B. Everett, ward of the plaintiff, while a passenger on a train of the defendant, was severely injured in a derailment, and on November 21, 1928, instituted an action in her own name in the Jefferson county, Ky., circuit court, seeking to recover from the defendant $65,000 damages for personal injuries received in the accident.
