Appeal from a judgment of the Supreme Court at Special Term, entered April 13, 1979 in Albany County, which granted petitioner’s application, in a proceeding under CPLR article 78, to vacate an order issued by the Department of Transportation. On September 16, 1976 petitioner applied for a permit to operate as a contract carrier so that it could enlarge its transportation capacity from that of a taxi.
