The defendant appeals from an order granting the application of the New York Dock Company for an alternative writ of mandamus, by which the defendant is directed to show cause why he should not certify a voucher pursuant to the provisions of the Rapid Transit Act (Laws of 1891, chap. 4), as amended,* in favor of the relator for the sum of $21,000, with interest on $9,000 thereof from the 6th day of August, 1918; on $9,000 thereof from the 6th day of February, 1919, and on the remaining $3,000 from the 18th day of December, 1919, by reason of the claim asserted by the relator…
