HENDERSON, Circuit Judge:

Reginald Hall appeals his conviction and sentence for possession of a check stolen from the mail in violation of 18 U.S.C.A. § 1708 (1970). 1 An indictment charging the appellant with one count of forgery and one count of possession of a stolen government check was returned by a grand jury in March, 1979. At the trial in August, 1979, the District Court for the Northern District of Florida entered a judgment of acquittal on the forgery count, 2 but the jury returned a verdict of guilty on the possession count.
