CHADICK, Chief Justice.

This is a plea of privilege case. Wilma C. Cox, a resident of Gregg County, sued her former husband, Neil D. Cox, for $2,-001.00, alleging that he fraudulently misrepresented material facts as to the amount of community property they owned at the time of their divorce by filing a false and fraudulent inventory and appraisement. Neil D. Cox timely filed a plea of privilege in which he alleged that he was a resident of Walker County, and subject to it a special exception that the petition did not state a cause of action.
