MEMORANDUM OPINION AND ORDER DISMISSING COMPLAINT

THIS MATTER comes before the Court on the parties’ cross motions for Summary Judgment.
The facts are as follows. Plaintiff Paradise Valley Country Club (hereinafter “Paradise Valley”) filed a Chapter 11 petition in this Court on November 26, 1980. On or about March 6, 1981, the Court approved Plaintiff’s assumption of a lease between it and the Defendant, Sun Valley Development Company (hereinafter “Sun Valley”).
