In this patent infringement action, defendants have filed an amended answer and *494counterclaim pleading in greater specificity their allegation that plaintiffs violated their duty of candor to the Patent and Trademark Office (“PTO”). Defendants allege that plaintiffs’ inequitable conduct render the patent in-suit unenforceable. To support this defense, defendants seek to depose certain individuals involved in the prosecution of the patent in-suit.
