HILL, Circuit Judge.
This is an appeal from a defendant’s judgment upon a jury verdict in an action brought to recover damages for personal injuries resulting from an automobile accident. Two jury trials have been had in the case. The first trial resulted in a verdict for the plaintiff which was overturned by the granting of *963a new trial. At the second trial the jury-returned a verdict in favor of appelleedefendant.
