EDELSTEIN, Chief Judge:

The instant motion arises out of pretrial discovery proceedings in the above captioned action. Defendant International Business Machines Corporation (IBM) has moved this court for an order (1) compelling Richard C. Stead-man and Don E. Ackerman to answer certain questions their counsel instructed them not to answer during oral deposition1 or in the alternative (2) striking their names from the Department of *217Justice’s list of witnesses and precluding the Department of Justice from using their testimony at trial.
