Appellee brought this suit in the District Court of Tom Green County against appellant, as an ordinary action of trespass to try the title to a strip of land off of the east side ■of lot number 17, block number 1, in the town of San Angelo, Texas, said strip of land being 2)- feet wide and 91)- feet long.

The appellant, who was defendant in the court below, pleaded a general denial, the statute of limitations of three and five years, and permanent and valuable improvements.

A jury was waived, and the case submitted to the court, and judgment was rendered for…
