DUNKLIN, Chief Justice.

Huey & Philp Hardware Company, a Texas corporation, instituted this suit against Staples & Fowzer, another Texas corporation, and against Frank Fowzer, individually, to recover an indebtedness of $1,399.48, and, upon its application therefor, R. F. Henderson was appointed receiver of the assets of the defendant corporation. The receiver took charge of such assets and operated the business theretofore carried on by Staples & Fowzer.
