On February 26, 1965, defendant was convicted by a jury in the District Court of Hennepin County of theft of a portable television set from the Romsaas Furniture Company in Minneapolis in violation of Minn. St. 609.52, subd. 2(1 ). On March 12, 1965, after a presentence investigation he was sentenced to the custody of the commissioner of corrections at the Stillwater State Prison for an indeterminate term.
