The plaintiff, a laborer, having agreed to lease from John Gilbert, a tenant of defendant, a room in a dwelling house owned by defendant and one-half of which was leased to Gilbert, sustained physical injuries while he was moving his belongings into the room, and he seeks recovery in damages from defendant charging that the injuries were caused by the defective condition of the premises.
