Appeal from a judgment of the County Court of Albany County (Clyne, J.), rendered December 22,1980, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the fourth degree. On December 4, 1980, defendant entered a plea of guilty to the first count of an indictment charging him with criminal possession of a controlled substance in the fourth degree, a class C felony, in full satisfaction of a four-count indictment.
