Appeal from a judgment of the County Court of Clinton County (Goldman, J.), rendered October 6,1982, upon a verdict convicting defendant of two counts of the crime of criminal sale of a controlled substance in the third degree. Defendant was indicted on two counts of criminal sale of a controlled substance in the third degree (Penal Law, § 220.39, subd 1) and, after a trial by jury, was found guilty as charged.
