This suit was commenced in this Court on February 2, 1956 by the plaintiff against the defendant to recover damages for personal injuries sustained by him on November 6, 1955, while he was employed by the defendant as a switchman in its yards at Seattle, Wash*716ington. He was engaged in the performance of his duties as a member of the switching crew in making certain switching movements in the yards.
