This is an appeal from the trial court's denial of defendants' motion for JNOV or, in the alternative, for a new trial in an action for personal injuries suffered in an automobile accident caused by a defect in the road.

On December 10, 1984, Patricia Rogers Davis and her sister, Tina Ingersoll were traveling south on Highway 49 a few miles south of Dadeville. The right rear tire of the Chevrolet van in which they were riding slid off the road into a rut or drop-off.
